Hayibo taking credit for my work

Hayibo is South Africa’s version of The Onion, but with less bling and a considerably smaller budget. So, they can be forgiven for cutting corners in their attempts to grow the brand.

Is it forgivable to use my cartoons (in this instance, my Che Guevara one) without my knowledge? Yes. So long as the usage is fair.

Is removing my signature fair? Sometimes.
But, is removing my signature, as well as not crediting me, fair?

I’m not so sure. It doesn’t sit comfortably with me.

Or other readers, for that matter.

That’s very poor form. Crediting you would have cost them nothing, asking your permission first would have been much better. [Wesley, via Facebook]

And their email form does not work. I tried to tell them that plagiarism is wrong. [Guy, via Facebook]

This isn’t about policing. (In fact, I only noticed after Wilhelm noticed.)

This is really just about being fair.

Update

Hayibo‘s Tom Eaton responded in the comments below and apologised via email.

Another update

Hayibo publicly responded and I publicly responded to their public response.

  1. Jacoba says:

If they needed to trim the pic they should have credited you or even written something about you and your cartoons. I think it’s shocking.

  2. cloudgazer says:

    they’re a bunch a cunts.
tried contacting them – but their contact form doesn’t work.

  3. Jerm says:

Cloudgazer, they don’t respond to tweets either.

  4. Steve Crane says:

I thought they were funny, but now I see they’re just a joke.

  5. MOB says:

    Sue them!

  6. kenda says:

I could not agree more! They of all people should have known better. Buggers also owe me a hoodie I paid for when they were cash strapped and closed down a while back. No cash back – no hoddie. A different kind of theft to yours but still theft in my book.

  7. Lozza says:

That’s amazingly shitty form. But then, if they had any integrity, they would have real jobs at proper papers.

  8. Lozza says:

Did I say integrity? I meant talent, too. ;)

  9. phr0ggi says:

    Wow.
    Poor form.
It’s not that difficult to credit someone especially when it’s clear who the source is.

  10. Tom Eaton says:

Hi Jerm, I published the pic. It was sent to me (sans your signature) by a mate. I am replacing it on Hayibo as we speak.

  11. Travis says:

A likely story, Hayibo. How can you work in the “humour” arena and not be aware of Jeremy’s cartoons? How can you just go ahead and publish someone else’s work without even bothering to do a simple search on its origins? You should pay Jeremy for the use of his cartoon. You are a commercial site. You owe him more than to simply take his cartoon down. You ow him a huge apology on your site.

  12. Jacoba says:

The photograph has been replaced Travis – an apology would have been the decent thing to do.

  13. slipknot says:

This is what Tom should have said above” Sorry Jerm, I published the pic.It was sent to me(sans your signature)by a mate.I am replacing it on Hayibo as we speak”.
    That’s the correct way !!
Very very unprofessional for a commercial site.

  14. Tom Eaton says:

    Hello Jerm’s fans.
I have mailed him personally to apologize for what was an honest but stupid mistake. I would also like to apologize to you, who support him and his work. We are going to mention the mix-up in our newsletter tomorrow, with a link to this site, so hopefully your ranks will be swelled.
    TE.

  15. Jason says:

@Tom – Good on you. Some people fall off the trollie now and again with remarks but I believe we all human and as such we make mistakes.

  16. Jason says:

@Tom – As a side note I think what you should take from this is fix your contact page and maybe come to an agreement with Jerm. If you bribe him enough I am sure he will make you some legit cartoons for your tabloid.

  17. slinky says:

Tom, thank you that’s what was needed to be said and done, accepted !

  18. slinky says:

Tom, what you need to do now is to contact Jerm directly and arrange for him to draw cartoons for you in the future.
I’m sure he will give you a decent response, maybe even draw for free for awhile untill you’re on your feet,he’s a very nice guy .

  19. Jerm says:

Who needs business partners when you have readers? Ha ha.

  20. Jacoba says:

I don’t think you owe us an apology since it really has nothing to do with us. However, you will find that we’re all very protective of Jeremy – as he said, you need only have credited him for the cartoon – everyone makes mistakes and this kind of thing can happen.

  21. Jerm says:

For that matter, who needs business partners AND BODYGUARDS when you have readers? :-)

  22. phr0ggi says:

Well done to Hayibo for copping it.
Quick responses are what it’s all about.

  23. Tyrone says:

Jerm, you have come out of this looking a whole lot worse than Hayibo. They’ve been dignified and apologised. You and your fans have induldged in name calling and silly insults. Could have been handled better perhaps??

  24. shadehades says:

i just found your site via the link to it from hayibo

    keep on keeping on…

  25. Lola says:

Came here by Hayibo’s link. You and all 6 of your fans were so effended by a small negligence, it’s unreal!

Did you thank Hayibo for the reference, by the way?

  26. Fred says:

    Found you via Hayibo…
With politics all publicity is good publicity.
Never heard of you before so its thanks to hayibo!!

  27. Fred says:

    All publicity is good.
Thanks to Hayibo we now know about you.

  28. Jacoba says:

Come come come – I read all the comments above. Jerm didn’t make a fuss – some of his readers did. Let’s not overdo the recriminations.

  29. shadehades says:

how about a toon showing all the hayibo fans & all the jerm fans making peace

like a kinda hayibo-jerm-stock hippy celebration

oh, it could be so wonderful

all the fans from each side kissing & cuddling

yanno make-up sex is always the best, huh?
